1. Acceptance of Terms

By accessing this website and submitting any design, artwork, text, or graphics (collectively referred to as "Design"), you agree to be bound by these Terms and Conditions, all applicable laws in India, and any specific submission guidelines posted on the site. If you do not agree, please do not submit any Designs.

2. Intellectual Property & Grant of Rights

By submitting a Design to the website, you do not transfer ownership of your copyright. Instead, you grant the website an exclusive, worldwide, royalty-free, sub-licensable, transferable, and irrevocable license to:

  • Use, reproduce, modify, adapt, publish, distribute, and display the Design in any media.

  • Print, manufacture, market, distribute, and sell commercial merchandise—including but not limited to t-shirts, apparel, and accessories—featuring your Design.

  • Use your name, username, or likeness in connection with the promotion and marketing of the manufactured products and the competition.

Legal Note: Under Section 19 of the Indian Copyright Act, 1957, any assignment or license must clearly state the duration and territorial extent. By agreeing to these terms, you explicitly agree that this license granted to the website is worldwide in territorial scope and perpetual in duration, unless explicitly terminated in writing by mutual consent.

3. User Warranties and Representations

By submitting a Design, you warrant and represent that:

  • You are the sole creator and undisputed owner of the Design, or you possess all necessary licenses, rights, and permissions to grant the rights mentioned above.

  • The Design is completely original and does not infringe upon the intellectual property rights (including copyrights, trademarks, or design rights), privacy rights, or moral rights of any third party.

  • The Design complies with all applicable Indian laws and does not contain any defamatory, obscene, politically sensitive, or unlawful content under the Information Technology Act, 2000.

4. Indemnification

You agree to indemnify, defend, and hold harmless the website, its owners, directors, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Any breach by you of these Terms and Conditions, including the warranties regarding third-party copyright or trademark infringement.

  • Any claim that your Design caused damage to a third party.

5. Compensation, Prizes, and Exposure

  • The Winner: Only the designated winner(s) of the competition, as determined by the website's judging criteria or voting process, will be eligible to receive financial compensation, prizes, or rewards. The specific prize details will be announced separately for each competition cycle.

  • Other Participants: If your Design is not selected as a winner, you acknowledge and agree that you will not receive any monetary compensation, royalties, or profits generated from the sale of merchandise featuring your Design. Your compensation for participating and granting the website the usage rights is limited solely to the public exposure, platform visibility, and marketing promotion your design receives on our website and social media channels.

6. Limitation of Liability

To the maximum extent permitted by Indian law, the website shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your submission of a Design or the website's use of that Design.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms, the website, or the use of submitted Designs shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
